Goods are delivered by courier to addresses in the Republic of South Africa. This policy applies to every Order accepted by Branded Workwear, whether placed online or accepted in writing against a written quotation, and to Goods supplied blank as well as Goods branded with the Customer’s logo.
Delivery areas
Delivery is made to a street address nominated by the Customer on the Order, at which a person is available to receive the Order during business hours. Outlying areas may carry a longer lead time and a higher delivery charge, both stated on the quotation before the Order proceeds. Collection from the Branded Workwear premises in uMhlanga is available by prior arrangement.
Delivery cost
- Delivery is charged separately from the price of the Goods and from the cost of branding.
- The delivery charge is quoted with the Order and is calculated on the size, weight and destination of the consignment.
- Prices displayed on the website include Value Added Tax at 15%. Quotations state Value Added Tax separately.
- Prices exclude branding and delivery unless the quotation states otherwise.
- Delivery to more than one address, or in more than one consignment, is charged and quoted per consignment before the Order proceeds.
- Goods collected by the Customer carry no delivery charge.
Lead times
The lead time applicable to an Order is stated on the quotation. Lead times stated are estimates and are subject to the section headed Execution within 30 days below.
Unbranded Goods
The lead time for unbranded Goods is stated on the quotation and starts on written acceptance of the quotation by the Customer. Orders placed online are dispatched in accordance with the lead time confirmed to the Customer on the Order.
Branded Goods
- A written quotation and a branded mockup are issued at no charge within 24 working hours of the request.
- An Order for branded Goods proceeds on written acceptance of the quotation and approval of the Artwork.
- Production begins only after the Customer approves a written or digital Proof. No production takes place against a verbal approval.
- The lead time for branded Goods starts on approval of the Proof and is confirmed to the Customer on that approval. It does not start on the date of the Order.
- The lead time is extended by any period during which the Proof remains unapproved.
- Any change to the Artwork after approval requires a fresh Proof, and a fresh lead time applies from approval of that Proof.
- Errors present in an approved Proof are the responsibility of the Customer. Deviations from the approved Proof are corrected by Branded Workwear at its own cost.
- The branding method applied to the Order, being embroidery, screen print, digital transfer or laser engraving, is stated on the quotation.
Execution within 30 days
An Order is executed within 30 days of the day on which the Order was received, unless a longer period has been agreed with the Customer. Where the quotation states a lead time longer than 30 days and the Customer accepts that quotation in writing, the period stated on the quotation applies.
Where the Order is not executed within 30 days, or within the agreed longer period, the Customer may cancel the Order on 7 days’ written notice, in terms of section 46 of the Electronic Communications and Transactions Act 25 of 2002. Any amount paid by the Customer in respect of a cancelled Order is refunded within 30 days of the date of cancellation.
Collection
- Goods are collected from 69 Meridian Drive, Prestondale, uMhlanga, 4319, KwaZulu-Natal, by prior arrangement.
- Collections take place between 08:00 and 17:00, Monday to Friday.
- The Customer is notified when the Order is ready for collection. The Order is not collected before that notification.
- The person collecting the Order quotes the Order or quotation number.
- Payment arrangements for Goods collected are confirmed in writing before collection.
Payment on delivery
Pay on Delivery is available on Orders placed online. Payment is made in full to the driver or courier at the point of delivery, in cash or by card, and the Order is handed over against that payment. Payment terms for Orders placed against a written quotation are stated on that quotation. Goods remain the property of Branded Workwear until the Order has been paid in full.
Inspection at delivery
- The Customer may examine the Goods at the time of delivery and may refuse to accept Goods that do not correspond with the description, sample or type ordered, in terms of section 19 of the Consumer Protection Act 68 of 2008.
- Where part of the delivery does not correspond with the Order, the Customer may accept the balance of the delivery and refuse the remainder.
- Goods refused at delivery are handed back to the driver or courier unused and in the original packaging.
- Branded Goods produced in accordance with an approved Proof correspond with the Order. An error present in the approved Proof is not a ground for refusal at delivery.
- Signature at delivery confirms receipt of the stated number of parcels in apparent good order. It does not limit the Customer’s rights in respect of shortages, damage or defects that were not apparent at delivery.
Cancellation after delivery
A natural person who placed the Order online may cancel the Order without reason and without penalty within 7 days of delivery, in terms of section 44 of the Electronic Communications and Transactions Act 25 of 2002. The cost of returning the Goods is for the Customer’s account.
Goods branded, personalised or otherwise made to the Customer’s specification are excluded from that right in terms of section 42(2)(f) of the Electronic Communications and Transactions Act 25 of 2002, and from change of mind cancellation in terms of sections 17 and 20(3)(b) of the Consumer Protection Act 68 of 2008.
Risk and transit damage
- Risk in the Goods passes to the Customer on delivery, or on collection where the Customer collects the Order.
- Damage in transit, shortages and incorrect Goods are reported in writing to info@brandedworkwear.co.za within 48 hours of delivery.
- A report of transit damage includes photographs of the damaged Goods, the inner packaging and the outer carton, together with the Order or quotation number.
- Goods reported as damaged in transit are kept in the condition and packaging in which they were delivered until Branded Workwear has assessed the report.
- Damage caused after delivery, including damage caused by storage, handling, washing or use, is not transit damage.
- Reports made after 48 hours may not be accepted as transit damage. This does not limit the Customer’s rights in respect of defective Goods.
- Where Goods are found to be defective within 6 months of delivery, the Customer may return the Goods and choose a repair, a replacement or a refund, in terms of section 56 of the Consumer Protection Act 68 of 2008.
Failed delivery and incorrect addresses
- The Customer is responsible for the accuracy of the delivery address and contact details given on the Order.
- A delivery fails where the address is incorrect or incomplete, where no person is available to accept the Order, or where payment is not made at the point of delivery.
- Goods returned after a failed delivery are held at the uMhlanga premises pending instruction from the Customer.
- A further delivery charge applies to any redelivery following a failed delivery, and is quoted to the Customer before redelivery.
- Where the Customer changes the delivery address after the consignment has been handed to the courier, any redirection charge raised is for the Customer’s account.
- The Customer is contacted at the details given on the Order to arrange redelivery or collection of an undelivered Order.
Personal information
The name, delivery address and contact number stated on the Order are given to the courier for the purpose of delivering that Order, and are not used for any other purpose. The Customer may ask what personal information is held, ask for it to be corrected or deleted, and object to its processing, in terms of the Protection of Personal Information Act 4 of 2013. Requests are made in writing to info@brandedworkwear.co.za.
A complaint about the handling of personal information may be made to the Information Regulator (South Africa) at complaints.IR@inforegulator.org.za or at inforegulator.org.za.
