What this policy covers
This policy covers every item we supply: corporate clothing, workwear, headwear and promotional gifts, blank or branded with your logo by embroidery, screen print, digital transfer or laser engraving.
Goods supplied without branding are Blank Goods. Goods branded to your order are Branded Goods. The written or digital layout you approve before production is the Proof.
Two order routes are covered: orders placed on brandedworkwear.co.za with pay on delivery, and orders placed against a written quotation, which proceed once you accept the quotation in writing and approve the Proof.
Read this policy with the Branded Workwear Terms and Conditions. Nothing in it limits your rights under the Consumer Protection Act, No 68 of 2008, as amended, or the Electronic Communications and Transactions Act, No 25 of 2002, as amended.
Your rights under the Consumer Protection Act
Where the Consumer Protection Act applies to the transaction, you hold the rights below, and no term of this policy limits them.
- Inspect the goods on delivery and refuse goods that do not match the description, the sample or your order, in terms of section 19.
- Receive goods that are reasonably suitable for their intended purpose, of good quality, in good working order and free of defects, in terms of section 55.
- Return defective goods within 6 (six) months of delivery and choose a repair, a replacement or a refund, in terms of section 56.
- Take delivery at the agreed time and place, and refuse delivery tendered outside that arrangement, in terms of section 19.
Sections 17 and 20(3)(b) of the Consumer Protection Act exclude goods produced to your special order from the right to cancel an advance order and return goods for a change of mind. Branded Goods are produced to your special order.
Orders not executed within 30 days
Where you placed an order electronically and we have not executed it within 30 (thirty) days of the date we received it, you may cancel on 7 (seven) days’ written notice, in terms of section 46 of the Electronic Communications and Transactions Act. Any amount you have already paid is refunded within 30 (thirty) days of the date of cancellation. This does not apply where a longer period has been agreed in writing, and the lead times stated on your quotation and confirmed on approval of the Proof are such an agreement.
Cooling off on unbranded stock items
If you are a natural person and concluded the transaction electronically, you may cancel it within 7 (seven) calendar days of receiving the goods, without reason and without penalty, in terms of section 44 of the Electronic Communications and Transactions Act.
This right applies to Blank Goods only. Send written notice to info@brandedworkwear.co.za inside the 7 (seven) day period, stating your order number and the items cancelled.
Return the goods in the condition set out under Condition of returned goods below. The direct cost of returning them is for your account. Amounts you paid are refunded in full, less that direct return cost, within 30 (thirty) days of the date of cancellation.
Section 44 does not apply to orders placed by a juristic person.
Goods branded to your order
Branded Goods are excluded from the cooling-off right by section 42(2)(f) of the Electronic Communications and Transactions Act, which excludes goods made to the specification of the consumer or personalised to the consumer. Branded Goods are not returnable for a change of mind, an artwork change, a size change, a colour change or a reduction in quantity once production has started.
Production starts only after you approve a written or digital Proof. Telephonic Proof approvals are not accepted.
An error in an approved Proof is your responsibility. This covers spelling, wording, logo version, layout, branding position, branding size and colour reference as they appear on the Proof you approved. Such an error is not grounds for a return, a credit or a refund.
A deviation from the approved Proof is our responsibility. Goods that deviate from the approved Proof are rebranded or replaced at our cost, including the cost of return transport, and you may choose a refund in place of rebranding or replacement.
Colour references are confirmed on the Proof, and the Proof governs the branding produced.
Defective Branded Goods are dealt with under Defective goods below.
Defective goods
You may return defective goods within 6 (six) months of the date of delivery, in terms of section 56 of the Consumer Protection Act, and choose a repair, a replacement or a refund. The choice is yours.
This right applies to Blank Goods and Branded Goods alike.
Returned goods are assessed on receipt. Where the return is for a branding defect, they are assessed against the approved Proof.
Damage that is not a defect
The following are not defects for the purposes of this section:
- Fair wear and tear.
- Damage from misuse, abuse, neglect or use for a purpose other than that for which the goods are intended.
- Damage from washing, drying, ironing or laundering contrary to the care instructions on the garment label, including industrial laundering of garments not specified for industrial laundering.
- Damage from alteration, hemming, resizing, repair or rebranding carried out after delivery by anyone other than us.
- Fading, shrinkage or distortion arising from the causes listed above.
Incorrect or short delivery
You are entitled to inspect the goods on delivery and to refuse goods that do not correspond with the description, the sample or your order, in terms of section 19 of the Consumer Protection Act. Where you refuse goods at delivery on this basis, nothing is payable on the refused goods.
Record shortages, incorrect items, incorrect sizes and incorrect colours on the delivery note or waybill at the time of delivery. Where the discrepancy is not apparent on inspection at delivery, notify us within 48 (forty-eight) hours of delivery.
Confirmed shortages are supplied, and confirmed incorrect items are collected and replaced, in each case at our cost. You may choose a refund of the amount paid for the items concerned in place of supply or replacement.
Damage in transit
Risk in the goods passes to you on delivery, or on collection where you collect from our uMhlanga address.
Record damage that is apparent on delivery on the delivery note or waybill before the driver or courier leaves, and refuse the damaged items.
Report damage that is not apparent on delivery within 48 (forty-eight) hours of delivery, with photographs of the damaged goods, the inner packaging, the outer carton and the waybill. Keep the damaged goods and all packaging until the claim is finalised.
No claim for damage in transit is accepted after the 48 (forty-eight) hour period, or where the packaging was discarded before the claim was finalised.
Confirmed transit damage is remedied by replacement or by refund at your election, at our cost.
How to lodge a return
Get written authorisation from us before you return, credit or exchange any goods. Goods received without written authorisation are held unprocessed and returned to you at your cost.
- Contact us inside the period applicable to the return, on 031 577 1131, on WhatsApp on 081 391 4224, or by email to info@brandedworkwear.co.za. Office hours are 08:00 to 17:00, Monday to Friday.
- State your order number, the date of delivery, the item codes, the quantities, the sizes and colours concerned, and the reason for the return.
- Attach photographs where the return is for damage in transit, a defect or a deviation from the approved Proof.
- Wait for written authorisation from us, which states the items authorised for return and the return arrangements.
- Return the goods with a copy of the written authorisation enclosed, either to the courier we arrange or, by prior arrangement, to 69 Meridian Drive, Prestondale, uMhlanga, 4319, KwaZulu-Natal, during office hours.
Condition of returned goods
Goods returned under the cooling-off period are to be unworn, unwashed, unaltered and unbranded, in their original packaging, with all swing tags, labels and seals attached and intact.
Goods returned as defective, incorrect or damaged in transit are to be returned in the condition in which you received them, with all packaging and accessories, and are not to be washed, altered or repaired before return.
Pack returned goods so that they are protected in transit. Where you arrange the return transport, risk in the goods stays with you until we receive them. Where we arrange the return transport, risk passes on collection by the courier.
Goods returned in a condition that does not meet this section are assessed on receipt, and you are advised in writing of the outcome.
Who pays return transport
The direct cost of returning goods under the cooling-off period is for your account.
The cost of returning goods that are defective, incorrect, short supplied, damaged in transit or deviate from the approved Proof is for our account. Return transport in these circumstances is arranged by us, and return transport you arrange without written authorisation is for your account.
Delivery cost is quoted with your order, based on size, weight and destination. Where the return arises from a defect, an incorrect or short delivery, damage in transit or a deviation from the approved Proof, the delivery cost paid on the items concerned is refunded.
Refund method and timeframe
Payment on website orders is taken on delivery, in cash or by card.
Refunds go by electronic funds transfer to a bank account in your name, or by reversal to the card used on delivery where you paid by card. Supply your banking details in writing. Banking details are not accepted telephonically, and drivers and couriers are not authorised to pay refunds.
Refunds on cancellations under the cooling-off period are processed within 30 (thirty) days of the date of cancellation. All other refunds are processed within 30 (thirty) days of our acceptance of the returned goods.
Displayed prices include 15% VAT, and refunds of amounts paid at displayed prices include that VAT. Quotations state VAT separately, and refunds of amounts paid against a quotation include the VAT charged on the items refunded. Prices exclude branding and delivery unless stated otherwise.
Goods that cannot be returned
No return, credit, exchange or refund is granted on the following, unless the goods are defective in terms of section 56 of the Consumer Protection Act, do not correspond with your order, or deviate from the approved Proof:
- Branded Goods, including goods branded by embroidery, screen print, digital transfer or laser engraving.
- Goods produced, altered, assembled or personalised to your specification.
- Goods worn, washed, laundered, altered, hemmed, resized or marked after delivery.
- Goods branded, printed, engraved or otherwise decorated after delivery by anyone other than us.
- Goods with swing tags, labels or seals removed, and goods returned without their original packaging.
- Goods damaged after delivery through misuse, incorrect care or incorrect laundering.
- Goods returned without our written authorisation.
- Goods returned after the period applicable to the return under this policy has expired.
Your personal information
Personal information you supply in support of a return is processed to assess and settle that return, in terms of the Protection of Personal Information Act, No 4 of 2013, and our Privacy Policy.
You may ask what personal information we hold about you and request a copy of it, in terms of section 23. You may ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully, in terms of section 24. You may object to the processing on reasonable grounds, in terms of section 11(3). Send these requests to info@brandedworkwear.co.za.
